092.      TO CONSIDER THE CONSULTATION DOCUMENT FROM DEVON COUNTY COUNCIL FOR A STREET CAFÉ LICENCE

Members considered the consultation and observed (as they had done during the planning application process) that the proposed site is too narrow and not suited for a street café licence.

Proposed by Councillor Christie, seconded and

RESOLVED: That the street café licence is refused on the grounds that the area proposed is at the narrowest point of the street and is therefore not suitable for a licence. Members would encourage the applicant to re-apply to use the area to the side of the premises in the lowest part of Lower Gunstone Street where there is a natural and more pleasant space that could be used.

(Vote – For: 5, Against: 0)

094.      PLANNING APPLICATIONS

a.          Application No: 1/0088/2018/FUL: New public entrance, internal alterations to ground floor and infill ground floor office extensions under first floor cantilevered overhang. Torridge District Council, Riverbank House, Bideford, Devon. Applicant: Torridge District Council (same address). Agent Name: Heighway Field Associates, Exeter. (Date received: 19 Feb 18).

Proposed by Councillor Bushby, seconded and

RESOLVED: That the application is approved.

(Vote – For: 5, Against: 0)

b.         Application No: 1/0183/2018/FUL: Variation of condition 2 off 1/0877/2017/FUL To alter the internal floor layouts and front (west) elevation to provide a more flexible layout. Orion House, 14 Clovelly Road, Bideford, EX39 3BU. Applicant: Mr & Mrs B Dyer, Linton Support, 16 Clovelly Road, Bideford. Agent Name: AJ Design, 16 Treburley Close, Treburley, Launceston, PL15 9PG. (Date received 22 Feb 18).

Proposed by Councillor Bushby, seconded and

RESOLVED: That the application is approved.

(Vote – For: 5, Against: 0)

c.        Application No: 1/0605/2017/OUTM: Outline application (with all matters reserved except access) for the erection of up to 260 dwellings with public open space, landscaping and sustainable drainage system (SuDS) and two vehicular access points from Abbotsham Road (AMENDED INFORMATION including enlargement to red edge and reduction in number of proposed dwellings). Land North Of Abbotsham Road, Abbotsham, Devon. Applicant:Turner & Gladman Developments Ltd, Gladman House, Alexandria Way, Congleton CW12 1LB. Agent: None supplied. (Date received: 23 Feb 2018).

Proposed by Councillor Christie, seconded and

RESOLVED: That the application is refused on the following grounds.

• Accessibility onto Abbotsham Road is limited and could be seen as dangerous due to this being at a narrow part of the road and there being no safe walking for residents and school children, especially at the beginning and end of the school day. There is also no plan for school age children to cross Abbotsham Road to the new school in the Winsford Development.
• The site for dwellings would be badly related to the Town Centre for shops and services.
• Bideford Town Council is not satisfied that the public foul drainage network has the capacity to support the development without causing downstream sewer flooding and we would question the ability of the Cornborough facility to handle all the new flows (including this one).
• We would oppose the closure of Osborne Lane/Scratchyface Lane and can see no reason for it.
• A new Environmental Survey is essential as the amendment includes a large area of the Ancient Woodland. And for the same reason a Wildlife and Badger survey needs to be carried out.
• Great concern about the increased traffic flow from the time construction starts with no extra infrastructure in place.
• An air quality survey is essential due to increasing concerns for the air quality in the area and especially below the Viaduct.
