101    APOLOGIES FOR ABSENCE

There were no apologies for absence.

102    DECLARATIONS OF INTEREST

Councillor P S Christie declared a personal interest in agenda item 5.i. (Member, Torridge District Council).

103    PUBLIC PARTICIPATION SESSION

A member of the public spoke with regards to Planning Applications Nos:

•    1/1055/2011/FUL:  97 Stucley Road
•    1/0306/2011/FUL:  23 Park Lane
•    1/0303/2011/COU:  Lamb Inn
•    1/0305/2011/LA: Westcombe Council Depot

He noted that no wildlife report and in particular a bat report accompanied any of the above applications.  He felt that these applications would benefit from such reports.

The Minutes of the meeting held on 30 March 2011 were approved and signed as a correct record.

105    PLANNING APPLICATIONS

a.    Application No 1/0243/2011/FUL:  Replacement of existing conservatory and balcony.  Mystique, Graynfylde Drive, Bideford EX39 4AP.  – Applicant:  Ms S Kesseler (same address).  (Date received:  23 Mar 11)

RESOLVED: That the application is approved.

b.    Application No 1/1055/2011/FUL:  Proposed two storey extension.  97 Stucley Road, Bideford EX39 3EJ.  – Applicant:  Mr D Cook (same address).  (Date received:  29 Mar 11)

RESOLVED: That the application is approved. The Council notes that there is no wildlife report on the original application although this is not mandatory yet.

c.    Application No 1/0234/2011/CPL:  Certificate of Proposed Lawful Use: single storey extension and porch.  18 Lane Field Road, Bideford EX39 3QY.  – Applicant:  Mr Mark Pooley (same address).  (Date received:  30 Mar 11)

RESOLVED: That the Council cannot reach a decision on the application using the accompanying paperwork as it is not clear why a Certificate of Proposed Lawful Use has been applied for in this case.  The Council would require clarification for this case and any similar applications.

d.    Application No 1/0266/2011/FUL:  Vehicular Access.  83 Barton Tors, East-the-Water EX39 4HA.  – Applicant:  Mr Brian Bayliss (same address).  (Date received:  31 Mar 11)

RESOLVED: That the application is refused on the grounds that although the application says vehicular access, the garden area is currently used for industrial processes and allowing this application to go ahead would only exacerbate the situation and lead to a loss of greenery in the area.

e.    Application No 1/0286/2011/FUL:  Retrospective concrete garage.  Land at Chestnut Drive, Bideford EX39 3HE.  – Applicant:  Mr James Bennett, 63 Lane Field Road, Bideford EX39 3RD.  (Date received:  31 Mar 11)

RESOLVED: That the application is approved in principle but the Council would like to register its disapproval of retrospective applications.

f.    Application No 1/0306/2011/FUL:  Single storey rear extension, loft conversion including flat roofed dormer and demolition of outbuilding.  23 Park Lane, Bideford EX39 2QL.  – Applicant:  Mrs J Morris (same address).  (Date received:  4 Apr 11)

RESOLVED: That the Council has no problem with the extension but is concerned with the possibility of overlooking from the proposed dormer windows and on this basis will have to recommend refusal of the whole application. The Council notes that there is no wildlife report on the original application although this is not mandatory yet.

g.    Application No 1/0303/2011/COU:  Change of use of existing public house into four self-contained flats and associated works.  Lamb Inn, 83 Honestone Street, Bideford EX39 2DH.  – Applicant:  Mrs A Launder (same address).  (Date received:  5 Apr 11)

RESOLVED: That the Council would not oppose a change of use but believes that 4 flats is excessive given the size of the property.  It therefore recommends refusal of the application. The Council notes that there is no wildlife report on the original application although this is not mandatory yet.

106    PLANNING APPLICATIONS – NOTIFICATION OF DECISIONS BY PLANNING AUTHORITIES

The Committee noted the content of those Planning Applications which had been granted/refused by Planning Authorities since the last meeting.

The business of the meeting having been completed, the Chairman thanked the members for their attendance and the Meeting concluded at 7.15 pm.
